By accessing or using the CreativeCyber website and RiskSage platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. Description of Service

CreativeCyber provides a Governance, Risk, and Compliance (GRC) platform designed to assist organizations in managing cybersecurity risks and regulatory compliance. The Service includes access to digital tools, risk assessment frameworks, automated reporting features, and educational resources.

3. User Responsibilities

3.1 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You notify us immediately of any unauthorized use of your account. CreativeCyber is not liable for any loss or damage arising from your failure to protect your account information.

3.2 Accuracy of Data

You agree to provide accurate, current, and complete information during the registration and risk assessment process. Inaccurate data inputs may lead to incorrect risk scores or compliance reports, for which CreativeCyber bears no responsibility.

3.3 Prohibited Use

You may not use the Service for any illegal purpose, to transmit malicious code, or to attempt to gain unauthorized access to our systems or data.

4. Intellectual Property

All content, software, risk methodologies, and visual interfaces included in the Service are the exclusive property of CreativeCyber or its licensors and are protected by Indian and international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.

5. Disclaimer of Warranties

5.1 No Guarantee of Compliance

While our tools are aligned with RBI, SEBI, and DPDP frameworks, using our Service does not guarantee that your organization will be found compliant by regulatory authorities. Compliance is a continuous process dependent on your implementation of controls.

5.2 No Immunity

Use of the RiskSage platform does not grant immunity from cyberattacks, data breaches, or regulatory penalties.

5.3 Advisory Nature

The information provided by the Service constitutes general risk management advice and does not substitute for professional legal counsel.

6. Limitation of Liability

To the maximum extent permitted by law, CreativeCyber shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business reputation, arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount paid by you to CreativeCyber in the twelve (12) months prior to the event giving rise to the liability.

7. Termination

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra.
