By accessing or using any Creative Cyber platform or service ("Service"), you agree to be legally bound by these Terms of Service ("Terms"). If you are entering into this agreement on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms, and the term "you" refers to both you individually and that organisation.
If you do not agree to these Terms, you must not access or use our Services.

Creative Cyber provides a suite of enterprise cybersecurity, governance, risk, and compliance (GRC) platforms purpose-built for Indian regulated enterprises. Our three products are:

All platforms are enterprise-grade, invite-only SaaS services. Access is granted exclusively through a structured business engagement process. Creative Cyber does not offer self-service registration, free trials, or free tiers on any of its products.
Our Services are designed for business and professional use only. To access any Creative Cyber platform, you must:
Creative Cyber reserves the right to refuse, suspend, or revoke access at its sole discretion, including where eligibility requirements are not met.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must:
Creative Cyber shall not be liable for any loss or damage arising from your failure to protect your account credentials.
You agree to provide accurate, current, and complete information during registration and throughout your use of the Service. Inaccurate data inputs may lead to incorrect risk scores, compliance assessments, or regulatory reports, for which Creative Cyber bears no responsibility.
You may authorise users within your organisation to access the Service under your account, subject to the role-based access controls (RBAC) configured within each platform. You are responsible for all actions taken by authorised users under your account and for ensuring all such users comply with these Terms.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
Creative Cyber reserves the right to immediately suspend access for violations of this section without prior notice.
All content, software, algorithms, risk methodologies, compliance frameworks, visual interfaces, documentation, and other materials comprising the Service are the exclusive property of Creative Cyber or its licensors, and are protected by Indian and international copyright, trademark, patent, trade secret, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service solely for your organisation's internal compliance and risk management purposes during the term of your subscription.
You retain all ownership rights in the compliance data, assessment inputs, evidence artefacts, and other content you upload or enter into the Service ("Your Data"). By submitting Your Data, you grant Creative Cyber a limited, worldwide licence to host, store, process, and display Your Data solely as necessary to provide the Service to you.
Creative Cyber will not use Your Data for purposes other than providing and improving the Service, and will not share Your Data with third parties except as described in our Privacy Policy.
Creative Cyber processes personal data in accordance with our Privacy Policy (available at creativecyber.in/privacy-policy), which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
For enterprise customers, a Data Processing Agreement (DPA) is available on request. To the extent you submit personal data of your organisation's employees, customers, or other individuals into the Service, you are the Data Fiduciary and Creative Cyber acts as a Data Processor under the DPDP Act, 2023.
Access to Creative Cyber platforms is provided on a subscription basis. The following general terms apply:

Creative Cyber endeavours to maintain high availability of all platforms. However:
Creative Cyber shall not be liable for any losses resulting from platform downtime, maintenance, or technical failures beyond our reasonable control.
While our platforms are aligned with RBI, SEBI, IRDAI, DPDP Act, CERT-In, and ISO frameworks, use of the Service does not guarantee that your organisation will be found compliant by any regulatory authority. Compliance is a continuous process dependent on your implementation of controls, organisational practices, and responses to regulatory developments.
Use of any Creative Cyber platform does not grant immunity from cyberattacks, data breaches, ransomware, or other security incidents. Our tools assist in identifying, managing, and documenting risk posture; they do not prevent incidents.
The information, assessments, scores, reports, and recommendations generated by the Service constitute general risk management guidance and do not constitute legal advice. You should consult qualified legal and compliance professionals for advice specific to your regulatory obligations.
The Service is provided "as is" and "as available", without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law:
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, Creative Cyber's liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Creative Cyber and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach any provision of these Terms, or if we determine (in our sole discretion) that continued access poses a risk to the Service, other users, or third parties.
You may request termination of your account by contacting info@creativecyber.in with reasonable advance notice. Termination requests are subject to the terms set out in our Refund & Cancellation Policy.
Upon termination: (a) your right to access and use the Service will immediately cease; (b) provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will continue in full force.
Creative Cyber shall not be in breach of these Terms or liable for any delay or failure to perform any obligation under these Terms if such delay or failure results from circumstances beyond our reasonable control, including acts of God, natural disasters, epidemic or pandemic, government actions, war, civil unrest, cyberattacks by third parties on critical infrastructure, or failures of third-party internet or telecommunications services.
We may update these Terms from time to time to reflect changes in our services, applicable laws, or business practices. Material changes will be communicated by:

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India.
Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of thirty (30) days.
